Terms of Service

These terms cover your use of Launchly (golaunchly.com), run by Brian Fehr in Lubbock, Texas ("Launchly", "we", "us"). By building a preview or buying anything from us, you agree to them. If something here is unclear, email brian@golaunchly.com.

What Launchly does

You answer questions about your business and Launchly generates a website from your answers. Building and previewing a site is free. The preview is watermarked and can't be downloaded. You can also upload a website you already have (a ZIP or an HTML file). We host it as you made it and connect your lead inbox, dashboard and domain.

Unlocking your website ($49, one time)

Packages

The one-time fee is charged at checkout with your first month. The monthly fee covers hosting and your plan's ongoing features.

Optional add-ons (Starter)

Subscriptions

The monthly part of every package is a subscription with no contract or minimum term. It renews monthly on the same date until you cancel. You can cancel anytime from the billing page (Stripe Customer Portal) linked from your private order link, or by emailing us. When you cancel, your plan stays active until the end of the period you've paid for; after that your site is no longer hosted and the plan's features switch off. If you move from Care or Care Plus to Starter, the owner dashboard, Pay/Book buttons and quote form switch off, and your stats and saved messages are kept in case you come back. If a renewal payment fails and isn't fixed, we may stop hosting your site. You keep the website file you unlocked either way.

Pay online and Book now buttons

These buttons send your customers to the payment or booking provider you choose (for example Square, PayPal, QuickBooks, Venmo or Calendly). Those payments and bookings are between you, your customer and that provider, under the provider's terms. Launchly doesn't process, hold or refund that money.

QuickBooks Online connection (Care Plus)

The optional QuickBooks connection sends leads from your website to your own QuickBooks Online company as customers and, for quote requests, draft estimates. You need your own QuickBooks Online subscription. You stay responsible for what you send from QuickBooks (prices, taxes, invoices). The connection is provided as is, may be paused if Intuit changes or interrupts its service, and you can disconnect it at any time. QuickBooks and Intuit are trademarks of Intuit Inc.; Launchly isn't affiliated with or endorsed by Intuit.

Review Booster

Review Booster is included in Launchly Care and Care Plus. For Starter it's an optional add-on for $5/month, billed as its own monthly subscription that you can cancel anytime from your billing page. If your Starter plan ends, the add-on is canceled too. If you move to Care or Care Plus, the add-on ends at the close of the period you've paid for, because it's included there. With the add-on, your dashboard shows the Review Booster section only; the other Care features aren't included.

When you use Review Booster you agree that:

Launchly doesn't write, edit, post, remove or filter reviews, and doesn't promise any number of reviews or ratings. Text message requests aren't available yet.

Get Found

Get Found is included in Launchly Care Plus at no extra charge. For Launchly Care it's an optional add-on: $149 one-time setup plus $49/month, billed as its own subscription that you can cancel anytime from your billing page. If you move from Care to Care Plus, the separate add-on is canceled and the unused part is credited, so you aren't charged twice. If your plan ends, Get Found ends too. It isn't available on Starter.

With Get Found we help set up your Google Business Profile and manage it with the Manager access you give us, list your business on directories such as Bing, Apple and Yelp, and keep those listings up to date each month. You own your Google Business Profile and any directory accounts; you can remove our access at any time. Verification by Google or a directory has to be done by you as the owner. Ads management isn't included.

No guaranteed rankings. Google, Bing, Apple, Yelp and other services decide on their own whether, where and how your business appears, and whether a profile or listing is approved. Launchly doesn't control their results and doesn't promise any ranking, position, number of calls, visitors, leads or reviews.

You confirm that the business details you give us are accurate and that you're allowed to list the business.

Bring your own site (Care Plus)

You can upload a website you already have (a ZIP or an HTML file). We host it as you made it and connect your lead inbox, dashboard and domain. Bring your own site is included with Care Plus at no extra charge.

Featured example (showcase) option

At checkout you can choose to let Launchly feature your website as an example. If you do, the one-time website fee for your plan is reduced by $49 (for Starter, the website fee is waived entirely). Monthly hosting is charged at the normal price. You allow Launchly to show your business name (with your trade and town), a screenshot of your website and a link to it on golaunchly.com. Launchly reviews each site before it appears and may decline or remove any site at any time.

You can turn featuring off at any time from your dashboard or private order link. If you do, the $49 you skipped is added to your next bill (we don't charge your card right away), and we remove your site from golaunchly.com promptly, usually within minutes. The $49 is added only once per website, even if you turn featuring back on and off again, and turning it back on is free. If Launchly decides to stop showing your site, you are not charged. The $49 reduction applies once per website, can't be combined with promo codes or other offers, and does not apply to upgrades, which are charged at their normal prices.

Payments

Payments are processed by Stripe. We never see or store your full card number. Prices are in US dollars.

Refunds: the Care ($99) and Care Plus ($199) setup fees are fully refundable within 7 days of purchase if your site isn't live yet. Other payments, including the $49 Starter fee, Starter add-ons and monthly plan charges, aren't refundable. See our Refund Policy.

Domain names bought through Launchly (draft)

With Launchly Care or Care Plus you can buy a new domain name from us (for example, a .com for $22.00 a year). We register it in Launchly’s registrar account at Cloudflare Registrar, connect it to your website and renew it each year while you pay the yearly domain fee. The first year is charged when you buy it; after that the domain fee renews yearly, charged about 30 days before the domain’s renewal date, at the price shown when you bought it. If the registry raises its price, we’ll tell you before the next renewal.

The domain name is yours. Launchly holds the registration on your behalf. When your Launchly account is paid up, we’ll transfer the domain to you or to the registrar you choose when you ask. Domain registries don’t allow a domain to move to another registrar for 60 days after it’s registered, so a transfer can happen from day 61. Keeping your domain in your own name and paying for it yourself after a transfer is up to you.

If you cancel the domain renewal or it isn’t paid, we turn off automatic renewal and the domain stays connected until the end of the year you paid for; after that it can expire and someone else could register it. Ask us before then if you want to keep it.

If we can’t register the name you paid for (for example, someone else registered it first), we refund the domain charge automatically. Once a domain is registered, the domain charge isn’t refundable, because the registry doesn’t refund us. Premium-priced names aren’t offered.

Acceptable use

Don't use Launchly to build sites for illegal activity, spam, phishing or scams, or to impersonate someone else, and don't try to break or overload the service. We may refuse or remove a site that does. Uploaded sites must not contain malware, hidden crypto-miners, trackers that collect data without notice, phishing pages or content that infringes someone's rights. We limit what scripts can do on uploaded pages (they run in a restricted sandbox and can't load scripts from other websites) and may block or remove files that break this.

Copyright complaints

If you believe a site hosted by Launchly copies your work, email brian@golaunchly.com. We may remove the content and tell the site's owner.

Availability and changes

We work hard to keep Launchly and hosted sites online, but we can't promise uninterrupted service. We may update the product, our prices for new purchases, or these terms. If we make important changes, we'll update the date above.

Limitation of liability

Launchly is provided "as is". To the extent the law allows, we aren't liable for indirect or consequential losses (like lost profits), and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Your responsibility to us

If someone makes a claim against Launchly because of your content or how you use your site, including a third-party rights claim about content you upload (for example, that it infringes their copyright), you agree to cover our reasonable costs of dealing with it.

Governing law

These terms are governed by the laws of the State of Texas, USA. Any dispute will be handled in the courts of Lubbock County, Texas, unless the law requires otherwise.
